These terms cover bluebirdmontrose.com and every Montrose Brief we publish. The site and the briefs are run by Freshcod3s LLC, a West Virginia limited liability company (“we” or “us”). Using the site or opening a brief means you accept these terms.
1. What the service is
Bluebird Montrose produces a document called a Montrose Brief. A brief reports public government records about one property, as those records were retrieved on the date stated in the brief. Every line in a brief carries the source it came from and the date that source was read.
A brief is a snapshot. Records can change after the date on the brief, and the brief does not update itself.
2. What a brief is not
A Montrose Brief is not:
- a property inspection
- a title search or title opinion
- an appraisal or valuation
- legal advice
It is not a substitute for any of those. A brief contains no score or ranking, and it makes no recommendation about any property. If you need an inspection, a title search, an appraisal, or legal advice, hire someone licensed to provide it.
3. Source records
A brief reports records held by third-party government systems, such as county and state offices. We do not control those systems or the records in them. We do not promise that the records are complete or accurate, or that they are still current on the day you read the brief.
Where we know a system’s coverage floor (the earliest date its records reach back to), the brief discloses it. If a record is absent from a system, that absence is not evidence that no such record exists. The record may predate the coverage floor, or it may be held by a system we did not query.
4. Your responsibility
Briefs are written for licensed real estate professionals, and most readers are agents or brokers. Before you rely on anything in a brief, and before you pass it to a client or advise a client based on it, verify it independently against the source. You remain responsible for your own professional obligations, including any duty of disclosure or due diligence that applies to you. A brief does not shift those obligations to us.
5. Limitation of liability
To the extent the law allows, Freshcod3s LLC is not liable for any decision made in reliance on a brief, or for any loss that follows from such a decision. This includes lost profits and claims made against you by others.
If we are found liable despite this section, our total liability for a brief is capped at the amount you paid for that brief. During early access, briefs are provided at no charge, so that cap is $0.
6. Intellectual property
The text of a Montrose Brief, along with its structure and format, is © Freshcod3s LLC. You may share a brief you received with the client or party it was prepared for. You may not resell it or republish it as your own, and you may not remove the source notes from it.
The public records a brief reports remain public. We claim no ownership of them, and nothing in these terms limits your right to obtain those records from their source yourself.
7. Acceptable use
Do not use automated tools, such as scrapers or crawlers, to fetch pages or briefs from this site.
Each brief lives at a private link. That link is for the person it was sent to and the client or party the brief was prepared for. Do not post brief links publicly or submit them to any indexing service.
8. Changes, governing law, and contact
We may update these terms. When we do, we will change the effective date at the top of this page. Continued use of the site after a change means you accept the updated terms.
These terms are governed by the laws of the State of West Virginia, without regard to its conflict-of-law rules. Disputes under these terms belong in the state or federal courts in West Virginia.
